Mainely Curves Rental Agreement

This agreement (further known as the “Agreement”) is made between Mainely Curves (further referred to as the “Lessor”) and the undersigned renter (further referred to as the “Renter”). By signing this Agreement, the Renter agrees to the terms and conditions outlined below regarding the rental of costumes from Mainely Curves.

I. Rental Parameters

• Rental Period: The rental period begins on the date of pickup or receipt of delivery and ends on the agreed return date as outlined below:

• Rental Fee: The total rental fee for the Lessee’s rental (as broken down on the invoice) includes the rental of the items(s) and any accessories (if applicable). Payment is due in full at the time of the rental agreement.

  
  

• Delivery/Pickup: If delivery or pickup is required, any associated fees will be outlined in a separate invoice. The Renter is responsible for ensuring all items are returned on time, regardless of delivery/pickup arrangements.

II. Rental Care

• Condition at Pickup: The Renter acknowledges that the item(s) are in good condition at the time of rental and agrees to return it in the same condition, subject to normal wear and tear.

• Cleaning: The rental must be returned clean and free of stains, odors, or damages. If the rental is returned in an unclean condition, the Renter will be charged a cleaning fee of $35 per item. This is subject to change based on the type of item rented.

• Storage: The rental piece must be stored in a clean, dry, and safe environment, away from any hazards such as pets, smoke, animals, mold/mildew, moisture, or extreme temperatures. The Renter should avoid wearing the rental item in environments where it may get excessively dirty or damaged (e.g., outdoor events, cooking).

• Alterations: The Renter may lightly alter or modify the item(s) to better fit their wearer, however, any alterations must not be permanent and must be removed before the return of the item(s). Any alterations that have caused permanent damage to the rental item or remain at the time of return will result in additional charges based on the amount of work necessary to restore or replace the costume. See Section IV for additional details.

III. Late Policy

• Late Return: The rented item(s) must be returned on the agreed return date. If the rented item(s) are returned late, the Renter will incur a late fee of $15 per item, per day.

• Grace Period: A grace period of 24 hours may be applied at the discretion of Mainely Curves. After the grace period, additional late fees will apply.

• Failure to Return: If the rented item(s) are not returned within 7 days of the agreed return date, the Lessor reserves the right to charge the Renter the full replacement cost of the item(s), in addition to any outstanding late fees regardless if the loss is due to the Renter's negligence or not.

IV. Damage Policy

• Damage Assessment: The Renter agrees to return the item(s) in the same condition it was received, with normal wear and tear as determined by the Lessor being acceptable. Any damage beyond normal wear and tear (e.g., rips, stains, broken zippers, missing accessories) will be assessed by Mainely Curves and the Renter will be charged accordingly.

  
  

• Damage Fees: If the item(s) are damaged, the Renter will be responsible for repair or replacement costs. The cost will depend on the extent of the damage and will be determined by Mainely Curves. Costs for repair or replacement will be determined on a case by case basis but may include:

  • Minor repairs: $20/hour

  • Major repairs: $40/hour

  • Full replacement: Piece dependent 

• Lost Items: Any missing accessories or components of the costume will be charged at the replacement value, which may include items such as wigs, props, jewelry, or other costume elements.

V. Acknowledgment and Agreement

By signing this Agreement, the Renter acknowledges and agrees to abide by the terms and conditions outlined above. The Renter is responsible for ensuring the costume is properly cared for and returned on time and in good condition. Mainely Curves reserves the right to charge for any damages, late fees, or unreturned items in accordance with this Agreement.
